David G. Derickson defended veterinarian Andrea Stinnett in her veterinary complaint and subsequent judicial appeals.
Stinnett was named in a complaint after her boss, top surgeon Stephen Gilson, was exonerated of the death of a dog at his Pet Urgent Care. The dog had presented as needing removal of a blockage, but the facility and the attending veterinarian, Stinnett, delayed the operation and performed an additional barium study instead. A delayed surgery was eventually performed but the dog subsequently died.
There are suggestions in the complaints that phone conversations and text messages with Gilson actually led to the delay and the barium study. Stinnett was named in a subsequent complaint and found that she failed to provide professionally acceptable procedures. She then went on to appeal and fight the ruling in court, with Derickson arguing in part that the Board acted in an arbitrary and capricious manner and that the Arizona Adminstrative Code cited ("professionally acceptable procedures") was too vague to be constitutional. The courts eventually found for the Board and the Supreme Court denied Stinnett's appeal.
